Terms and Conditions

1. BOOKING DEPOSIT AND COURSE FEES
Confirmation of booking will be provided upon receipt of completed online registration and verification of eligibility for the course booked.

Due to the Covid-19 crisis, we have adjusted our deposit procedure to allow flexibility for students and the current situation we all find ourselves in. We are not requesting deposits from students booking classroom and virtual courses, payment will be taken one week before the course commencement date if the minimum number of students required has been met. Students will be kept up to date as to the status of the course and we will endeavour to give at least two weeks’ notice if a potential postponement is required – though this may not always be possible depending on the circumstance.

By booking through our website you agree to these terms & conditions. As soon as we reach the minimum number of students required to run a course we will contact you to finalize payment. If payment is not received within 48 hours of confirmation that the course is going ahead, you will lose your space on the course.

Payment plans are available if you are not able to follow this payment procedure.

*If you are booking an online course through a Third Party company, full payment will be taken upon receipt of the booking.

2. PAYMENT
Payment can be made by bank transfer or with a credit or debit card online. Bank transfers must be sent in euro currency and bank charges are for the account of the student. An invoice will be issued upon full payment.

If sending a bank transfer please ensure the description of the transfer includes your name and order reference.

3. AFTERCARE
As a part of the Nautical Academy Europe aftercare, after your course has been completed, we keep the personal information that is strictly related to the course and certificate you earn with us. We keep information stored on our system in case a certificate is lost/stolen/destroyed, this is because we want to be able to support you in getting a replacement. You can request to delete your personal information from our system at any time but then our aftercare cannot be carried out, see more at our privacy policy.

4. CANCELLATION BY THE CUSTOMER
If more than four weeks’ notice of cancellation is provided, the student can be transferred free of charge to a later date or their place on the course can be transferred to another student.

If the notice of cancellation is provided between four and one weeks before the commencement date, and the Academy is unable to re-sell the place on the course, a cancellation fee of 50% of the course fee will be charged (to the authorized card when the booking was made).

If less than one week’s notice of cancellation is provided, and the Academy is unable to re-sell the place on the course, the full payment of the course fee shall be forfeited.

Course fees shall not be refunded for any reason once the course has started. Please note, we recommend you take holiday cancellation or personal travel insurance.

Notice of cancellation must be received in writing.

5. CANCELLATION BY THE ACADEMY
If the Academy has to cancel a course, before the commencement date, any course fees you have paid will be refunded in full.

No liability shall be attached to Nautical Academy Europe beyond refunding the course fee paid for the cancelled course, or unused portion if the course has already started. No payments shall be made for incidental costs.

As above, we recommend you take holiday cancellation or personal travel insurance.

If a course has to be postponed, once it has commenced, due to weather or issues beyond the control of the Academy, course fees will be transferred to a later date. Course fees are not refundable in such a case.

6. REFUNDS
Nautical Academy Europe shall not be responsible for any unused air tickets or unused portions of air tickets or unused services of any kind. Refunds are not provided on training fees, though fees paid may be transferred to other courses at the discretion of the principal.

7. DELAY OR FAILURE TO ARRIVE
If a student is likely to be delayed beyond the start time of the course, Nautical Academy Europe must be informed as soon as possible and must be notified in writing. It is at the discretion of the Academy if the fees paid can be transferred to a future course. If a student fails to arrive, for any reason whatsoever including illness, and Nautical Academy Europe has not been notified in writing, the course fee will be forfeited.

8. HEALTH POLICY
We ask you to inform the Academy upon booking of any health issues that may affect your suitability for participating in a practical course. A signed medical declaration must be completed at the time of booking. If there are any changes between completing the medical declaration and starting the course, the student must inform Nautical Academy Europe in writing. Nautical Academy Europe accepts no responsibility for the decision of the physical fitness of the customer to participate in a course. If a student has any medical problems, it is their responsibility to check with their GP that it is acceptable for them to join the course. Students must ensure that any personal medication is brought to the course.

9. LIABILITY
No liability is accepted for student’s personal possessions left in Nautical Academy Europe premises; this includes on the marina and onboard vessels used by Nautical Academy Europe. No liability is accepted for students whilst in, or on, any Nautical Academy Europe property or property used by Nautical Academy Europe or whilst embarking or disembarking any vessel used by Nautical Academy Europe. No liability is accepted for death, personal injury, damage, expense, or loss of any nature whatsoever sustained by any student other than in the case of proven negligence of Nautical Academy Europe or its instructor at the time of the incident. All students take part in any course at their own risk. The act of signing for a training course, either through an actual signature or submitting the form electronically, implies that the student has understood and accepted the terms and conditions of Nautical Academy Europe herein, including the risk disclaimer above and liability as explained in this document.

10. WEATHER
Your instructor/examiner will make decisions RE heavy weather training with the safety of the crew and vessel as the first priority. The instructor/examiner’s decision is final. If a course has to be postponed, once the course has commenced, due to weather conditions beyond the control of the Academy, course fees will be transferred to a later date. Course fees are not refundable in such a case.

11. FORCE MAJEURE
Nautical Academy Europe shall not be liable for any expenses incurred due to Force Majeure, including Act of God, weather conditions, strikes, and acts of Government, war, or any other occurrence beyond our control.

12. PROVISIONING
Lunch is not included during shorebased courses.

13. ALCOHOL
Nautical Academy Europe shall not be liable for any accidents that occur whilst a student is under the influence of alcohol. The consumption of alcohol is not permitted whilst underway. If a student arrives for a training course and is considered to be under the influence of alcohol, they will be asked to leave the course and no monies refunded.

14. SMOKING
Smoking is not permitted in any building used by Nautical Academy Europe. Nautical Academy Europe is located in a non-smoking building and students are requested to dispose of any cigarette butts in a responsible manner. We request that students do not smoke directly outside the Nautical Academy Europe building, as it is located in a residential block.

15. DRUGS
Recreational drugs of any kind are strictly forbidden on board any training vessel or in any property used by Nautical Academy Europe. If found, or suspected, the customer will immediately leave the course and no monies will be refunded, nor any additional travel expenses reimbursed.

16. STUDENT NEGLIGENCE
If irresponsible or negligent behaviour of a student leads to damage or loss of any item of Academy property, the student is responsible for replacement or repair. Students are requested to act with a duty of care and respect for the Academy property. Damages and breakages, howsoever caused, must immediately be notified to the instructor or Academy staff.

17. COMPLAINTS
Notice of any complaint should be made to your instructor/examiner at the time of the complaint arising. If the complaint cannot be resolved at that time, then a written complaint should be made to the office team at info@thenauticalacademy.net. A formal complaint, the student feels is still unresolved, should be made in writing to the principal of Nautical Academy Europe and will be dealt with as a matter of importance.

18. INSTRUCTOR/EXAMINER’S DECISION
The instructor/examiner’s decision is final. All students will accept all orders and decisions given by the instructor/examiner during any training provided by Nautical Academy Europe. The instructor/examiner’s authority is total, day and night, in accordance with Maritime Law. If for any reason a student does not accept an order from the instructor/examiner, or a designated substitute, the student shall be considered to be in breach of the terms and conditions of Nautical Academy Europe. If the student is placed ashore at the nearest port, no liability whatsoever shall attach itself to Nautical Academy Europe and neither shall the student have any redress for any expenses, nor any redress against the instructor/examiner as a result of any action or decision by the instructor/examiner.

19. PERSONAL INSURANCE
It is strongly advised for students to obtain their own insurance for sickness, illness, loss of course fees, loss of personal effects, cancellation or curtailment, travel disruption or delay, accidents, or any other reason the student considers appropriate for their activity and well-being.

20. EXAMINATIONS
If an examination has to be cancelled or postponed for whatever reason, the candidate may be offered a future examination date. If the examination has to be cancelled due to adverse weather, the student contribution towards the examiner’s expenses is forfeit according to the costs already paid for travel expenses. Examiner travel expenses for the re-arranged examination date must be shared between the exam candidates.

21. CERTIFICATES
Certificates will only be issued at the end of a course if, in the opinion of the instructor/examiner, the student has reached the standard required. The decision is final and to be accepted by all students. For certificates issued in the UK by an external authority; please allow time for receipt, processing, and return delivery. Nautical Academy Europe will not be held responsible for any delays in the receipt, nor any loss if delivery has been requested to an address other than that of the Academy. Lost certificates will incur a re-issue charge to cover costs of replacement, administration, and postage.

For certificates obtained via virtual courses, certificates will be issued digitally only when successful completion has been verified, the originals will be available to collect from the Academy when permitted or postage can be arranged for a small fee.

It is the responsibility of the individual student to ensure the certificate they wish to achieve, through the course they are booking, is what is required for their career path or recreational use/area. Nautical Academy Europe is not liable for refunds on courses and certificates delivered through training that do not meet the individuals’ requirements.

22. PERSONAL IDENTIFICATION
It is according to Spanish law that photographic identification is to be carried by all persons at all times.

23. COURSE DURATION
One day specialist courses start at 09:00hrs and will close by 18:00hrs. Each individual course will have its own specific joining information, please pay close attention to the document. Shorebased navigation courses start at 09:00hrs and will adhere to the minimum training hours as set by the guidelines of the RYA. When running a Yachtmaster shore-based course, an exam session will be scheduled following completion of the 40-hour tuition time; if a candidate chooses not to take the shore-based examination at that time, they must sign a disclaimer understanding that the shore-based certificate cannot be issued until the examination paper has been successfully completed and the candidate can be awarded a ‘pass’.

24. INSURANCE
Whilst the Nautical Academy Europe carries full public liability insurance you should satisfy yourself that you are covered for personal injury and cancellation.

25. PHOTOGRAPHS USED IN PROMOTIONAL MATERIAL
You agree that any photographs that are taken during training, that may feature you, can be used by Nautical Academy Europe and the SOVREN Group for promotional purposes. Photographs will never be taken of minors. In the event that the company is sold, the new owner would have the rights to all photographs and promotional material obtained by Nautical Academy Europe.

26. UNDER 18S
Nautical Academy Europe does not accept students under the age of 18.

27. DISPUTES
Any dispute should be brought to the attention of the instructor and/or principal at the earliest opportunity to be resolved. In the event of a dispute not being settled by mutual agreement, it is agreed that this agreement (contract) shall be governed by the laws of Spain and the parties submit to the non-exclusive jurisdiction of the courts of Palma de Mallorca. It is further agreed that all agreements between customers, clients and students, and staff of Nautical Academy Europe shall be governed by Spanish Law, even when the dispute occurs outside Spanish territorial waters.

28. 3RD PARTY COURSES
The Day Skipper/Watch Leader Navigation Theory, Yachtmaster Coastal/Offshore Theory, and Yachtmaster Ocean online theory courses are delivered by Urban Truant, an RYA Recognised Training Centre specializing in online training. By booking one of the aforementioned online courses through the Nautical Academy Europe website, you are confirming that you have read and agree with Urban Truant’s terms and conditions.

When booking a Maritime Training Academy course through Nautical Academy Europe, you will receive a 10% discount off the course fee. 29. ROYAL YACHTING ASSOCIATION
Nautical Academy Europe is a recognized Shorebased training centre of the Royal Yachting Association and is subject to regular inspections to ensure the quality of training.

30. THE MARSHALL ISLANDS
Nautical Academy Europe is a recognized training centre of the Republic of The Marshall Islands (Internantional Registries, Inc.) to provide the STCW Basic Safety Training courses as well as Designated Security Duties, Ship Security Officer and Advanced Fire Fighting.
